Completing the Quizzes is completely voluntary, and individuals are under no obligation to provide Quiz Information to the Company, but an individual may receive incentives from the Company, such as online points or rankings, in exchange for providing Quiz Information to the Company.
B. When an individual provides information to a Third Party and the Company subsequently purchases, licenses, or otherwise acquires the information from the Third Party (the "Seller"). Such purchased information may include, but is not limited to, an individual's name, email address, street address, zip code, telephone numbers (including cell phone numbers and carriers), SMS messaging details (e.g. date, time and content of the SMS message), birth date, gender, education and marital status, occupation, industry of employment, personal and online interests, and such other information as the individual may have provided to the Seller (together, "Third Party List Information"). When acquiring Third Party List Information, the Company seeks assurances from the Seller that the Seller has a right to transfer the Third Party List Information to the Company. The Company, however, is not responsible for any misrepresentation by the Seller or unauthorized sale of the Third Party List Information.
C. Other occasions when the Company obtains information from individuals include (1) when an individual is making a claim for a prize or seeking to redeem an incentive offered by the Company or by a Third Party, (2) when an individual requests assistance through the Company's customer service department, and (3) when an individual voluntarily subscribes to a service or newsletter offered by the Company (together, "Other Information").
D. The Company may use current technology to obtain certain information about an individual. Additionally, the Company may use other new and evolving sources of information in the future (together, "Technology Information"). As a result, the Company strongly encourages individuals to revisit this policy for any updates regarding its use of technology.
E. The Company may receive information about individuals from Third Parties or from other sources of information outside of the Company, including information located in public databases ("Outside Information").
F. Notwithstanding the various sources from which the Company collects information, the Company will never knowingly collect any personal information about children under the age of 13. If the Company obtains actual knowledge that it has collected personal information about a child under the age of 13, that information will be immediately deleted from our database. Because it does not collect such information, the Company has no such information to use or to disclose to Third Parties. B. The Company uses the Individual Information to create an account for each user which is then used to (a) verify the user's log in to that account, (b) allow the user to download the Company's toolbar for use with the Site, and (c) to verify the identity of challenged users.
Notwithstanding the foregoing, the Company does not use Individual Information to provide promotional offers by email to individuals or send unsolicited email messages. As a result, statutes requiring certain formatting for unsolicited email are not applicable to the Company's email messages. The Company does not use Individual Information to target advertising to an individual user, nor does it match a person's Quiz Information and Third Party List Information to other categories of Individual Information to make and improve profiles of individuals, to track a person's online browsing habits on the Internet, or to determine which areas of the Company's web sites are most frequently visited.
3. Dissemination of Individual Information.
The Company does not disclose, sell or transfer Individual Information to Third Parties for any purpose, unless such disclosure is in response to a subpoena, court order, and other legal process, or should the Company be subject to an acquisition, merger, sale or other change of control or business entity status, the Company reserves the right to transfer or assign the Information collected from the Website to the new or successor organization or entity.
4. Privacy Practices of Third Parties.
Advertising agencies, advertising networks, and other companies (together, "Advertisers") who place advertisements on the Website and on the Internet generally may use their own cookies, web beacons, and other technology to collect information about individuals. 6. Unsubscribe Procedures.
To unsubscribe or delete the Company's storage of your Individual Information, you must send an e-mail to the Company at feedback@quizulous.com. In the subject line of the e-mail, you must type "Delete My Account." The Company shall, within ten business days after receipt of your e-mail, delete any and all Individual Information in its possession regarding you or your account.
